1. Agreement to Terms

By accessing or using the website located at lawn-care-elgin-il.com (the "Site"), operated by Elite Elgin Lawn Care ("we," "us," or "our"), you ("you" or "Customer") agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must discontinue use of the Site and our services immediately.

These Terms apply to all visitors, users, and customers who access or use the Site or engage Elite Elgin Lawn Care for any service. By requesting an estimate, scheduling a service, or otherwise engaging with us, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

2. Description of Service

Elite Elgin Lawn Care connects property owners with vetted, insured lawn care professionals and crews for residential and commercial property maintenance services in Elgin, IL and the surrounding Fox Valley communities. Our services include, but are not limited to:

• Lawn Mowing and Edging
• Pressure and Power Washing
• Tree, Hedge, and Shrub Service (trimming, removal, and pruning)
• Snow Removal and Plowing
• Lawn Aeration and Dethatching
• Fertilization and Weed Control

We coordinate scheduling, facilitate communication between property owners and service partners, and ensure service quality standards are met. All physical lawn care, landscaping, tree work, snow removal, and related services are performed by independent service partners, not by Elite Elgin Lawn Care directly. We act as an intermediary to ensure you receive professional, reliable property maintenance from qualified and insured service professionals.

3. Service Estimates and Pricing

Elite Elgin Lawn Care provides free, no-obligation estimates for all services. All estimates are provided in good faith based on the information available at the time of assessment and are non-binding until both parties agree to proceed.

Final pricing may vary from the initial estimate based on the following factors:

• Actual property conditions discovered upon arrival (overgrowth, debris, terrain)
• Changes to the scope of work requested by the Customer
• Seasonal demand and material cost fluctuations
• Property size discrepancies between the estimate and actual measurements
• Additional work required due to unforeseen obstacles or conditions

Any material change in pricing will be communicated to the Customer and agreed upon before work begins. We do not perform work beyond the agreed scope without prior customer authorization. Payment terms, accepted methods, and billing schedules will be outlined at the time of service agreement.

4. Service Scheduling and Cancellation

Scheduling. Once a service agreement is established, Elite Elgin Lawn Care will coordinate a recurring or one-time service schedule based on the Customer's needs and the availability of our service partners. We make every reasonable effort to maintain consistent scheduling, but specific appointment times are approximate and may be subject to adjustment.

Cancellation Policy. Customers must provide at least 24 hours' notice to cancel or reschedule a service appointment. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee equal to a portion of the scheduled service cost. Weather-Related Delays. Outdoor services such as lawn mowing, aeration, fertilization, pressure washing, and tree work are weather-dependent. In the event of rain, severe storms, extreme heat, or other adverse weather conditions, services may be delayed or rescheduled at no additional cost to the Customer. Snow removal services are dispatched based on snowfall accumulation thresholds and may be subject to response time variations during major storm events. We will make reasonable efforts to notify Customers of weather-related schedule changes in advance.

Seasonal Contracts. Customers enrolled in seasonal or recurring service plans may terminate their agreement with 30 days' written notice. Any services rendered prior to the termination date remain due and payable.

5. Property Access and Conditions

To ensure safe and efficient service delivery, the Customer agrees to the following:

• Access. The Customer must ensure that service crews have clear, unobstructed access to all areas of the property where services are to be performed. This includes unlocking gates, providing gate codes, and clearing pathways as needed.
• Obstacles and Hazards. The Customer is responsible for removing personal items, toys, lawn furniture, garden hoses, and other obstacles from service areas prior to the scheduled appointment. Elite Elgin Lawn Care is not responsible for damage to items left in the work area.
• Pets. All pets must be secured indoors or in a fenced area separate from the work zone during service visits. We are not liable for injury to unsecured animals or for service delays caused by the presence of animals in the work area.
• Underground Utilities and Irrigation. The Customer is responsible for clearly marking the location of underground utilities, sprinkler heads, invisible fences, septic components, and any other subsurface features. Elite Elgin Lawn Care is not liable for damage to unmarked underground utilities, irrigation systems, or other buried features.
• Pre-Existing Conditions. We are not liable for pre-existing property damage, including but not limited to cracked sidewalks, deteriorated retaining walls, rotting fence posts, diseased trees, or eroded soil. Any pre-existing conditions noted during the initial assessment will be documented and communicated to the Customer.

6. No Warranty of Services

While Elite Elgin Lawn Care takes care to vet all service partners for experience, proper insurance coverage, and professionalism, we do not guarantee specific outcomes from any service performed. Lawn care, landscaping, tree work, and snow removal results are inherently variable and depend on numerous factors beyond our control.

Without limiting the foregoing, we make no warranties or guarantees regarding:

• Specific grass regrowth rates, turf density, or lawn color following any treatment
• Survival of trees, shrubs, hedges, or other plants after trimming, pruning, or transplanting
• Complete elimination of weeds, grubs, or other pests through fertilization and weed control programs
• Specific snow removal timing or the complete elimination of ice from treated surfaces
• The absence of equipment marks, tire tracks, or minor surface impressions on soft, wet, or saturated ground
• Restoration of surfaces to a specific condition through pressure washing

Results from lawn care services depend on many factors including but not limited to weather conditions, soil quality, sun exposure, the Customer's watering and maintenance habits, drainage patterns, and pre-existing lawn health. Services are provided on an "as is" and "as available" basis, and all implied warranties, including warranties of merchantability and fitness for a particular purpose, are expressly disclaimed to the fullest extent permitted by law.

7. Your Responsibility

To maximize the effectiveness of our services and ensure satisfactory results, the Customer agrees to:

• Watering Schedule. Maintain an appropriate watering schedule following fertilization treatments, overseeding, aeration, and other services where post-treatment irrigation is recommended. Failure to water as directed may significantly reduce the effectiveness of these treatments.
• Prompt Communication. Communicate any concerns, complaints, or issues regarding service quality within 48 hours of the service date. We cannot address concerns regarding work performed if reported after subsequent visits or extended periods of time.
• Accurate Property Information. Provide accurate and complete information about your property, including property boundaries, areas to be serviced, areas to be avoided, and any known hazards or special conditions.
• Service Preparation. Clear all personal belongings, debris, and obstacles from service areas before scheduled appointments. This includes moving vehicles from driveways prior to snow removal services.
• Compliance. Comply with all applicable local, state, and federal laws, including HOA regulations, local watering restrictions, and noise ordinances that may affect the timing or method of service delivery.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Elite Elgin Lawn Care, its owners, operators, employees, agents, and independent service partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of or damage to plants, trees, shrubs, grass, or other vegetation due to weather, disease, insects, drought, or other natural causes
• Property damage resulting from weather events, including wind, hail, flooding, or freeze/thaw cycles occurring after service is performed
• Minor cosmetic damage such as equipment marks, tire impressions, or surface scuffing on soft, wet, or recently thawed ground
• Damage to unmarked underground utilities, irrigation systems, invisible fences, or other buried features
• Loss of income, business opportunities, or property value
• Any damages arising from delays or interruptions in service due to weather, equipment failure, or circumstances beyond our reasonable control

In no event shall the total cumulative liability of Elite Elgin Lawn Care for any and all claims arising out of or related to our services exceed the total amount paid by the Customer to Elite Elgin Lawn Care during the twelve (12) months immediately preceding the event giving rise to the claim. This limitation applies regardless of the legal theory under which the claim is brought, whether in contract, tort, negligence, strict liability, or otherwise.

9. Indemnification

You agree to indemnify, defend, and hold harmless Elite Elgin Lawn Care, its owners, operators, employees, agents, service partners, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Site or our services
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your provision of inaccurate, incomplete, or misleading property information
• Your failure to prepare the property for service as outlined in these Terms
• Any claim by a third party related to your property or the services performed thereon

This indemnification obligation shall survive the termination of any service agreement and these Terms.

10. Intellectual Property

All content on the Site, including but not limited to text, graphics, photographs, logos, icons, images, audio clips, video clips, data compilations, page layout, and underlying code, is the property of Elite Elgin Lawn Care or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content from this Site without the prior written consent of Elite Elgin Lawn Care, except as permitted by applicable law for personal, non-commercial use.

11. User Conduct

When using the Site or engaging with Elite Elgin Lawn Care, you agree not to:

• Provide false, inaccurate, or misleading information in any form submission, estimate request, or communication
• Use the Site or our services for any unlawful purpose or in violation of any applicable local, state, national, or international law
• Attempt to gain unauthorized access to any portion of the Site, its servers, or any systems or networks connected to the Site
• Interfere with or disrupt the operation of the Site or the servers or networks used to make the Site available
• Use any automated system, including bots, scrapers, or crawlers, to access the Site for any purpose without our express written permission
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity

We reserve the right to refuse service, terminate accounts, and restrict access to the Site at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Elite Elgin Lawn Care has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available on or through any third-party website or service.

We strongly advise you to review the terms of service and privacy policy of any third-party website you visit.

13. Modifications to Terms

Elite Elgin Lawn Care reserves the right to modify, amend, or update these Terms at any time, at our sole discretion, without prior notice. Changes will be effective immediately upon posting the revised Terms on the Site. The "Last updated" date at the top of this page will be revised to reflect the date of the most recent changes.

Your continued use of the Site or our services following the posting of revised Terms constitutes your acceptance of and agreement to the updated Terms. It is your responsibility to review these Terms periodically to stay informed of any changes. If you do not agree with the revised Terms, you must discontinue use of the Site and our services.

14. Governing Law

These Terms and any disputes arising out of or related to these Terms, the Site, or the services provided by Elite Elgin Lawn Care shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.

Any legal action or proceeding that is not subject to binding arbitration under Section 15 below shall be brought exclusively in the state or federal courts located in Kane County, Illinois, and you consent to the personal jurisdiction of such courts.

15. Dispute Resolution

Informal Resolution. Before initiating any formal dispute resolution proceeding, you agree to first contact Elite Elgin Lawn Care at info@lawn-care-elgin-il.com and attempt to resolve the dispute informally. We will make good faith efforts to resolve any dispute within 30 days of receiving your written notice.

Binding Arbitration. If the dispute cannot be resolved informally within 30 days, any controversy or claim arising out of or relating to these Terms, the Site, or the services provided by Elite Elgin Lawn Care shall be settled by binding arbitration administered in the State of Illinois in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Elite Elgin Lawn Care.

16. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions. The unenforceable provision shall be replaced with a valid, enforceable provision that most closely reflects the intent of the original provision to the extent permitted by applicable law.
